New requirements for Tier 1 Skilled Migrants - July 2009

The Tier 1 Skilled Migration scheme has replaced the former HSMP visa. All skilled workers, both in the UK and abroad, are still able to apply under the Tier 1 (General) Skilled Migration programme.

Landmark decision for migrants under the highly skilled migrant programme - July 2009

The HSMP Forum Ltd brought Judicial Review proceedings against the Home Secretary on the basis that those highly skilled migrants who acquired their status before the qualifying period for indefinite leave to remain (ILR) was increased from four to five years should still be eligible for ILR after four years on the scheme.

Long Residence: Definition of 'Continuous Residence' (9th September 2008) - April 2009

Following a successful challenge to the UK Border Agency policy on Long Residence (indefinite leave to remain applications after 10 and 14 years of residence in the UK) in TT v The Secretary of State for Home Department [2008] UKAIT 38, the meaning of 'continuous residence' ­ a condition required to establish Long Residence - has been given it’s original interpretation.

Recent Changes - August 2008

There have already been significant and far-reaching changes made to the structure of immigration control in the last few months, with the introduction of various phases of the Points Based System. More are to come, along with changes to the acquisition of British nationality contained in the proposed Immigration and Citizenship Bill. We have been analysing these changes, as well as looking at their practical effects, and will be updating our site shortly with information on these changes and how they affect you.

New Visa Application Forms

New visa applications forms have been introduced by UK Visas for all overseas applications. From 16th November 2007, the old forms will cease to be accepted. There are a number of new forms and each comes with its own set of Guidance Notes and Information sheets. The Information Sheets are particularly useful in directing applicants to the correct application forms that should be used.
